What is a legal separation in the state of Illinois?
A legal separation in the state of Illinois is when you are legally married, but you are in essence separating all your financial assets, one from the other.
I don’t normally recommend legal separations, especially for people who are young. They’re very rarely used anymore in the state of Illinois and the reasons that they would be used would be to maintain certain health insurance because one spouse can’t insure another spouse if their divorced. Often times in a situation you will find that one spouse will maintain the health insurance and the way to do that is through a legal separation.
Other times people may have a religious objection to divorce and so a legal separation would be a way of living separate apartments and separating your actual financial assets but yet you’re still unfree to remarry.
