The selection of a mediator is typically done by agreement of the parties. A list of two or three mediators might be suggested and the parties will then discuss it and determine which one they might mutually agree upon.

In arbitration, the parties can agree to one arbitrator in a similar method, or they might each choose an arbitrator and then have those two arbitrators select the third arbitrator to present a panel of three arbitrators to determine and decide the dispute.
