After a divorce would I need to redo my estate plan?
A person who has received the divorce from their spouse, upon the day of their divorce, they are no longer part of the other person’s will.
By operation of law, if a wife was going to inherit money from her husband and was written into her husband’s will, the day they are divorced, the wife has relinquished any and all claims that she would have as an heir to the husband’s estate, and that is done by operation of law.
There is nothing that the husband or the wife would need to do to change their will. However, it would be wise, upon divorce for the parties to have an estate planner re look at their wills or trusts to figure out what needs to be changed in those documents.
